Bombay HC bars Dabur from highlighting 'NEEM' on toothpaste packaging

The Bombay High Court has issued an interim order preventing Dabur India from featuring the word "NEEM" as a primary element on its toothpaste packaging. This follows a trademark lawsuit filed by Jyothy Labs, as reported by Live Law. The court dismissed Dabur’s argument that the term is generic, noting that while the company may use the word for descriptive purposes, it cannot display it as a brand identifier. Jyothy Labs maintains that its predecessor began using "NEEM" for toothpaste products as far back as 1920.
