Supreme Court updates 'industry' definition after five decades
A nine-judge Supreme Court bench, headed by CJI Surya Kant, has decided that the 'triple tests' established in a 1978 ruling to define an 'industry' require reformulation. This updated definition will be applied prospectively to legal matters involving events that occurred prior to the implementation of the 2020 Labour Relations Code. The Court clarified that the core structure of the triple test will stay the same.
