Kerala HC: Sexual relations with minor wife constitute rape despite Muslim marriage

The Kerala High Court ruled that a Muslim man can be prosecuted under the POCSO Act for engaging in sexual activity with his minor wife. The court declined to dismiss a rape case against the man, who had contended that his 17-year-old spouse was legally married to him. Although he claimed their union was performed according to Muslim religious customs, the court dismissed his plea.
