Drunk driving charge requires scientific proof, not just smell of alcohol: HC
The Uttarakhand High Court has stated that the scent of alcohol by itself is insufficient to confirm a drunk driving charge without scientific backing. The court emphasized that a breathalyser or blood test is necessary to verify that an individual's alcohol concentration surpassed the legal threshold set by the Motor Vehicles Act, 1988. This remark was made during the proceedings of a road accident case.
